BDF TERMS & CONDITIONS

BDF Membership is provided for in BDF Rule 5-8 and these Terms & Conditions apply to your purchase of/application for BDF Membership from the Ballroom Dancers Federation Limited (“BDF”) whose address is 4 Magnolia Drive, Banstead, Surrey SM7 1AW.

References to “we”, “us” and “our” should be construed as references to BDF.

1. Introduction

By applying for BDF Membership you agree to be bound by the following Terms and Conditions. The Terms and Conditions do not affect your statutory rights as a consumer.

2. BDF Membership

2.1 The B.D.F. is a British Federation and as such members must fulfil the following criteria to be eligible for membership:

2.1.1 Be a British Citizen or be eligible to hold a UK Passport or be resident in Great Britain. (For the purposes of these rules, Great Britain includes Northern Ireland, as is the case with the British Dance Council). AND

2.1.2 …meet one or more of the criteria listed in clause 2.2.

2.2 There are four categories of BDF Members:

2.2.1 BDF Honorary Life Member;

2.2.2 BDF Full Member;

2.2.3 BDF Associate Member; and

2.2.4 BDF Affiliate Member

2.3 Amateur competitors may register with the BDF and these will be known as Amateur Registrants. Amateur Registrants are entitled to representation at the British Dance Council but are not entitled to voting rights, nomination for election onto the Executive Committee or attendance at General Meetings. There is no cost for this registration however you will no longer be eligible for BDF Amateur Registration if you terminate your amateur registration of the relevant bodies (BDC etc.). In each case you must notify the BDF of such termination or inform the BDF of any change in your amateur status. Your BDF Amateur Registration will renew automatically.

2.4 If you become a BDF Member in any category you will be eligible to receive certain membership benefits. The price and duration of the relevant benefits are subject to change over time at the sole and absolute discretion of the BDF (and in accordance with paragraph 2.10 below), but their duration will ordinarily run till March the following year.

2.5 BDF Honorary Life Member. The Executive Committee may recommend for election as Hon. Life Member any person who in the opinion of the Executive Committee has rendered services to the Federation. Any such recommendation to take effect shall be approved by a 75% majority of members present and voting at the Annual General Meeting. If you are accepted by the BDF as a BDF Honorary Life Member, you will receive Full Benefits of membership.

2.6 BDF Full Member. Professional dancer or have a Professional interest in Competitive dancing (Amateur Competitors may not apply for Full Membership). If you are accepted by the BDF as a BDF Full Member, you will receive Full Benefits of membership.

2.7 BDF Associate Member. Amateur dancer/competitor . If you are accepted by the BDF as a BDF Associate Member, you will receive Full benefits with the exception of voting rights and nomination onto the EC.

2.8 BDF Affiliate Member. If your association is accepted by the BDF as a BDF Affiliate Member, you as their member will not automatically be members of the BDF.

2.9 Only Honorary Life and Full Membership entitle you to vote at BDF Annual General Meeting.

2.10 Membership is non-transferable and any membership card or identification may only be used by you.

2.11 Every candidate for full membership shall be proposed and seconded by members of the Federation. His/Her full name, address and the names of the proposer and seconder shall be communicated in writing to the Honorary Secretary who shall cause these particulars to be exhibited in the Federation’s Offices, and in due course be presented to the Executive Committee for ratification. One month must elapse from acceptance before new members are entitled to vote.

2.12 Any benefits and services that may be made available to you by the BDF are at the sole and absolute discretion of the BDF and are subject to withdrawal at any time without notice to you. The BDF shall decide which benefits and services fall within the relevant categories of membership from time to time.

2.13 The BDF reserves the right, at its sole and absolute discretion and without assigning a reason, to refuse any application or renewal and to suspend, restrict or cancel the membership of any person. The BDF is not obliged to provide reasons for any action taken under this clause 2.13. However, potential reasons include, but are not limited to, an individual being in breach of these conditions or any further regulations and conditions from time to time prescribed by the BDF, a decision of a relevant (judged by the BDF) body or committee (for example, one of the BDF’s committees) or in the reasonable opinion of the BDF an individual being guilty of conduct which is detrimental to the reputation of the BDF or is detrimental to the interests of ballroom dancing or is otherwise offensive or dishonest in dealings with the BDF.

2.14 If payment is required and you are paying by debit or credit card we must receive full details of your debit/credit card with your application. On receipt of your application we will debit your debit/credit card for the price. However, our acceptance of your application remains subject to our approval. Once we have reached a decision on your application we will either confirm that your application has been accepted by us or notify you that we cannot accept your application. We will contact you by either sending an email or a letter to you at the email or postal address you provide in your application form. If we cannot accept your application and we have taken payment, we will confirm that your debit/credit card has been re-credited.

2.15 Our acceptance of your application brings into existence a legally binding contract between us, subject to you verifying your email address using the link sent to you by the BDF.

2.16 As we are a UK organisation, all charges advertised (unless otherwise indicated) are in Pounds Sterling. If you are purchasing from overseas, your card issuer will convert the charge into your local currency. This application form and our Terms and Conditions have been designed for use within the United Kingdom. Whilst we will consider requests for services from outside the United Kingdom, we give no warranty, expressed or implied, that our application form or the making of any application from outside the UK, complies with any applicable non-UK laws or regulations. Accordingly, any products or promotions not permitted under your local law are not offered to you. Furthermore, we reserve the right to refuse any application at our discretion from overseas customers and we will have no obligation to provide you with any reasons for refusing an order.

5. Prices and Delivery Charges

5.1 The prices payable for the BDF Membership provided to you are the prices set out on our website on the date of your application.

5.2 Our prices are inclusive of postage to addresses in Great Britain. Applicants from other areas will receive all communications electronically. The BDF will not cover the cost of postage to applicants from other areas.

5.3 Any overpayment of membership fees may not be reclaimed after six months have elapsed from the date of the overpayment.

6. Termination

6.1 You agree that on our acceptance of your application you will immediately become a BDF Member and will be entitled to all the benefits of membership (relevant to the packages you have applied for and subject to any restrictions which the BDF place) such that the membership service provided to you will begin at that time. In accordance with the Consumer Contracts Regulations 2013, you have the right to cancel the contract between you and the BDF at any time during the 14 days starting on the day on which the contract was entered into (i.e. on the day that your application is accepted by the BDF) and ending 14 days after the day on which the contract was entered into (the “Cancellation Period”). If you wish to cancel the contract during the Cancellation Period you must make a clear statement that you intend to cancel the contract by informing the BDF either by sending an email to memsec@ballroomdancersfederation.com or a letter to ‘Alejandro Hernandez, BDF Membership Organiser, 331 Reigate Road, Epsom Downs, Surrey KT17 3LT’ before the expiry of the Cancellation Period. You may use the cancellation form set out below to cancel the contract:

6.2 If you cancel the contract during the Cancellation Period in accordance with paragraph 6.2 above you will be reimbursed all payments received from you in respect of your application for BDF Membership. The BDF will make the reimbursement without undue delay and no later than 14 days after the day on which you informed us about your decision to cancel the contract. The BDF will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise and you will not incur any fees as a result of the reimbursement. If you request supply of any services or benefits available to you in respect of the contract during the Cancellation Period the BDF may deduct from the reimbursement an amount in respect of the services performed during the Cancellation Period.

6.3 If you cancel the contract after the Cancellation Date you will not be entitled to receive a refund from the BDF.

7. Warranties and Liability

Whilst every effort is made to ensure that the benefits and services provided by third parties (e.g. discounts) will be delivered and be of a suitable standard, the BDF is in no way responsible for such benefits and services, which will remain the sole responsibility of such third parties. The BDF makes no representation, warranty, recommendation or endorsement of the goods and services provided by such third parties and you accept that none is given or implied.

8. Changes to these Terms and Amendments to Content

BDF Membership is subject to such further regulations and conditions as may from time to time be prescribed by the BDF and published on our website (at www.ballroomdancersfederation.com).

10. Data Protection Act 1998 and the General Data Protection Regulation (EU) 2016/679

The BDF confirms that it will process your personal data in accordance with the BDF Privacy Policy, the Data Protection Act 2018 and the General Data Protection Regulation (EU) 2016/679 (all as amended and superseded at any time).

11. Governing Law & Jurisdiction

These Terms and Conditions and any related non-contractual obligations shall be governed by, and construed in accordance with, the laws of England and Wales and the parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any disputes that may arise out of, under, or in connection with these terms or the legal relationship established by them, and for those purposes irrevocably submit all disputes to the jurisdiction of the courts of England and Wales.

12. Entire Agreement

These Terms and Conditions, together with your application form, our current prices and contact details, set out the whole of our agreement relating to the supply of membership to you by us. Nothing said by any BDF representative on our behalf should be understood as a variation of these Terms and Conditions or as an authorised representation about the nature or quality of any goods/services offered by us. Except for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
