BDF TERMS & CONDITIONS

These Terms & Conditions apply to an application for, and purchase of, BDF Membership from the Ballroom Dancers’ Federation Ltd (“BDF”).

References to “we”, “us” and “our” mean the BDF.

1. Purpose and relationship with the BDF Rule Book

1.1 These Terms & Conditions govern the application for and purchase of BDF Membership and the contractual arrangements relating to that application and purchase.

1.2 The BDF Rule Book contains the BDF’s constitutional and membership rules, including eligibility, membership categories, members’ rights, voting, Executive Committee eligibility, subscriptions, suspension, removal, expulsion and other governance matters.

1.3 These Terms & Conditions are not intended to repeat, amend, replace or override the BDF Rule Book. Members are required to comply with the BDF Rule Book as amended from time to time in accordance with the Rule Book.

1.4 Where a matter concerns membership rights, governance or disciplinary powers dealt with by the BDF Rule Book, the applicable Rule Book provision shall apply. Nothing in these Terms & Conditions shall be interpreted as creating a different membership right or procedure.

1.5 By submitting an application for membership, you confirm that you have read, or have had the opportunity to read, the applicable BDF Rule Book and agree to comply with it.

2. Application for Membership

2.1 Applications must be made using the application process specified by the BDF.

2.2 The information required for membership is determined by the BDF Rule Book and the membership application. Applicants must provide accurate and complete information.

2.3 Submission of an application does not by itself constitute acceptance of membership. An application remains subject to the applicable membership requirements and the BDF’s acceptance and ratification procedures under the Rule Book.

2.4 The BDF may contact an applicant using the email address or postal address supplied with the application.

3. Membership Subscription and Payment

3.1 The applicable annual membership subscription is the amount stated on the current BDF membership form or BDF website at the time of application, subject to Rule 9 of the BDF Rule Book.

3.2 The annual subscription becomes due in accordance with Rule 9 of the BDF Rule Book.

3.3 Where payment is made by debit or credit card, the BDF may take payment when the application is submitted, subject to acceptance of the application.

3.4 If the BDF does not accept an application and payment has already been taken, the BDF will refund the payment using the original payment method, unless otherwise agreed.

3.5 All charges are in Pounds Sterling unless otherwise stated. Where an overseas card is used, the card issuer may apply its own currency conversion or charges.

3.6 Any claim concerning an overpayment should be notified to the BDF as soon as reasonably practicable and, in any event, within six months of the payment.

 4. Formation of the Contract

4.1 A contract for the supply of membership services is formed when the BDF accepts the application in accordance with the applicable application process.

4.2 Acceptance of an application may be subject to completion of any verification step specified by the BDF, including email verification.

4.3 Acceptance of an application does not alter or replace any membership requirement, qualification, right or procedure contained in the BDF Rule Book.

5. Membership Services and Third-Party Benefits

5.1 Membership benefits are those made available by the BDF for the relevant membership and are subject to the BDF Rule Book, the applicable membership package and any conditions communicated by the BDF.

5.2 The BDF may change the availability or content of discretionary membership benefits where permitted by the Rule Book and applicable law. No change to a benefit shall be interpreted as changing a member’s rights under the Rule Book.

5.3 Some benefits may be supplied by third parties. Where this is the case, the third party is responsible for the relevant goods or services. The BDF does not guarantee the availability, quality or suitability of third-party goods or services unless expressly stated.

5.4 Nothing in these Terms & Conditions constitutes an endorsement or recommendation of a third-party supplier unless expressly stated.

6. Cancellation and Refunds

6.1 Where the Consumer Contracts Regulations 2013 apply, a consumer may have a statutory right to cancel the contract within 14 days of the contract being entered into, subject to the Regulations.

6.2 If you wish to exercise an applicable statutory cancellation right, you must communicate your decision clearly to the BDF before the cancellation period expires. You may contact the BDF using the membership contact details published on the BDF website.

6.3 Where you expressly request that the supply of membership services begins during the cancellation period, and you subsequently exercise a statutory cancellation right, the BDF may deduct an amount proportionate to the service supplied up to cancellation where permitted by law.

6.4 Where a refund is due following a valid cancellation, the BDF will make the refund within the period required by applicable law and normally using the same payment method used for the original transaction.

6.5 Cancellation of a membership contract under consumer legislation does not amend or override the BDF Rule Book. Any separate question concerning membership status, suspension, removal or expulsion is governed by the applicable Rule Book provisions.

7. Suspension, Removal and Expulsion

7.1 The BDF’s powers and procedures concerning suspension, removal from the List of Members and expulsion are governed by Rules 25, 26, 32 and 33 of the BDF Rule Book.

7.2 Nothing in these Terms & Conditions creates a separate power to suspend, restrict, remove or expel a member, or a separate disciplinary procedure.

7.3 Any disciplinary action will be taken in accordance with the applicable BDF Rule Book provisions and applicable law.

8. Data Protection

8.1 The BDF will process personal data in accordance with the UK General Data Protection Regulation, the Data Protection Act 2018, the BDF Privacy Policy and other applicable data-protection legislation, as amended or replaced from time to time.

9. Communications

9.1 The BDF may communicate with applicants and members by email or post using the contact details supplied to the BDF.

9.2 Members should keep their contact details up to date so that they can receive BDF communications.

10. Changes to these Terms & Conditions

10.1 The BDF may update these Terms & Conditions from time to time to reflect changes in the membership service, applicable law or administrative arrangements.

10.2 No amendment to these Terms & Conditions is intended to amend the BDF Rule Book. Changes to the Rule Book must be made in accordance with the Rule Book itself.

10.3 The current version of these Terms & Conditions will be made available through the BDF’s official channels.

11. Liability

11.1 Nothing in these Terms & Conditions excludes or limits liability to the extent that such exclusion or limitation would be unlawful.

11.2 In particular, nothing excludes or limits liability for fraud or fraudulent misrepresentation or any statutory rights or liability that cannot lawfully be excluded or limited.

12. Contacting the BDF

12.1 Membership enquiries, including questions concerning applications, payment or cancellation, should be sent to the membership contact details published by the BDF.

12.2 General enquiries may be sent to the contact details published on the BDF’s official website.

13. Governing Law and Jurisdiction

13.1 These Terms & Conditions and any related non-contractual obligations are governed by the laws of England and Wales.

13.2 Subject to any mandatory consumer rights, the courts of England and Wales shall have jurisdiction in relation to disputes arising out of or in connection with these Terms & Conditions.

14. Entire Agreement and Interpretation

14.1 These Terms & Conditions, together with the applicable membership application, current subscription information and BDF Rule Book, set out the arrangements relating to the application for and purchase of BDF Membership.

14.2 These Terms & Conditions do not constitute a separate set of membership rules and should not be read as duplicating or replacing the BDF Rule Book.

14.3 If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall continue to apply to the extent permitted by law.

14.4 Nothing in these Terms & Conditions removes or limits any statutory right that cannot lawfully be excluded.

14.5 In the event of an inconsistency concerning a constitutional, governance, membership-right or

disciplinary matter, the applicable provision of the BDF Rule Book shall govern.

14.6 In the event of an inconsistency concerning the contractual purchase, payment, cancellation or provision of membership services, these Terms & Conditions shall govern, subject always to the BDF Rule Book and applicable law.
